"To be, or not to be" is the opening line of a soliloquy from William Shakespeare's play "Hamlet" and depending on what happens in Lansing during the next eight weeks may have parallels for public schools. However, the opening line should read "To fund, or not to fund?" as it applies to mandates handed down to schools from state and federal government.As a local superintendent and resident of Livingston County, I recognize the need to live within our means. In my personal life, I exert a great deal of control over my finances. Most of these controls are the result of choices I make. Will I drive a 10-year-old car for a few more years? Will I dine at home rather than go out for dinner on Friday night? These are choices I make. In a Michigan Public Radio report aired Feb. 24, 2010, Rick Pluta said, "a special commission report confirms the state has foisted billions of dollars in costs on local governments in violation of the Michigan Constitution." He also reported, "Legislative leaders say they will act quickly to ensure there's an end to the practice of unfunded mandates." Then-Democratic House Speaker Andy Dillon agreed with the findings. "The state unfortunately has developed a pattern and a history of imposing requirements on local units without funding them," said Dillon. Essentially, he acknowledged our state legislators have decided to openly violate our state constitution and the provisions established 33 years ago with the adoption of the Headlee Amendment. Accordingly, the special commission recommends allowing local government units to ignore laws that force costs on them until the Legislature appropriates resources. Examples of unfunded or underfunded mandates include, but are not limited to: an extended school year, new high school graduation requirements, special education, new staff evaluation requirements and bus inspections. Many unfunded mandates do not originate in Lansing but rather, Washington. Unfunded federal mandates amounted to only 27 in the 1950s and grew to more than 100 in the 1980s. According to the Mackinac Center for Public Policy, today we have more than 400 federal mandates that tie up resources and dictate policy to states. They all require states to provide services without helping them meet expenses.
